Inevitable costs

According to my understanding of rights of way legislation, security, loss of privacy, lack of use, nuisance, cost and maintenance are some of the matters that Nottinghamshire County Council cannot take into account when deciding if a right of way exists or not because there is other legislation in place to deal with these issues if they arise (Pathway Issues Prove Costly, Advertiser, January 5).
I am surprised that the rights of way committee has written to Government ministers complaining that it cannot take some of these issues into account when determining applications, and would have thought that the committee should have known this, since it is now responsible for deciding applications instead of experienced rights of way officers.
Mr Peter Hiley is correct (Rights Of Way, News Views, January 12). Highways authorities have statutory duties that have cost implications.
These apply to all authorities, including Nottinghamshire County Council. The authority cannot avoid this cost.
